The main issue here concerns judicial rulings that require the Canadian government to open up their classified sources in court, or else give up some of the evidence that has been used to put people on no-fly lists. The government chose the latter option, giving the lawyers for some of the terror suspects an opening for getting their clients’ names removed from the lists.
Mr. Harris relates the issue to the larger situation, which is the legal environment that makes Canada an attractive refuge for Al Qaeda operatives and other people with jihad on their minds.
