The blogger GW of Wolf Howling has spoken to Lionheart’s attorney, and confirms that a complaint has been filed against Lionheart with the police. The police are therefore obliged to arrest him pursuant to their investigation.
GW said this in an email to Gates of Vienna:
You can contact Lionheart’s attorney directly at this point if you want more information. Lionheart has approved him discussing the case with third parties. I am just letting you know that Lionheart is really facing prosecution.

I contacted Lionheart to get additional information about his claim that he faced imminent arrest, and he put me in contact with the attorney whom he has retained, Anthony Bennett (ajsbennett@btinternet.com). I spoke with Mr. Bennett, who confirmed the following facts:- - - - - - - - -
1. The Bedfordshire police have contacted Lionheart to arrange for him to submit to arrest.
2. Lionheart querried the police to find out why he would to be arrested. A Bedfordshire police officer sent Lionheart an e-mail, forwarded to me by Mr. Bennett, which read in pertinent part:
The offence that I need to arrest you for is “Stir up Racial Hatred by displaying written material” contrary to sections 18(1) and 27(3) of the Public Order Act 1986.
You will be arrested on SUSPICION of the offence. You would only be charged following a full investigation based on all the relevant facts and CPS consent.3. Mr. Bennett adds “There are already a number of aspects about this case involving not only ‘Lionheart’ but concerning other friends of his which are almost certain to result in a complaint being made to the Independent Police Complaints Commission.”
4. There has been nothing filed yet by the police that will tell us precisely what blog posts they will be using to prosecute Lionheart. The precise basis for the complaint will only become known after the arrest. Further, we do not yet know who was responsible for making a complaint to the police.
The Public Order Act of 1986 makes it an offense to “stir up racial hatred.” The act defines “racial hatred” as “hatred against a group of persons defined by reference to colour, race, nationality (including citizenship) or ethnic or national origins.” The law does not define the word “hatred.” The specific provisions of the Public Order Act of 1986 mentioned by the police in their e-mail to Lionheart are:
18 (1) A person who uses threatening, abusive or insulting words or behaviour, or displays any written material which is threatening, abusive or insulting, is guilty of an offence if — (a) he intends thereby to stir up racial hatred, or (b) having regard to all the circumstances racial hatred is likely to be stirred up thereby. 27 (3) A person guilty of an offence under this Part is liable — (a) on conviction on indictment to imprisonment for a term not exceeding seven years or a fine or both;
To call this law a gross assault on freedom of speech would be the height of understatement. It criminalizes the content of speech and it applies a wholly subjective threshold — “hatred” — for finding guilt. This law would be unconstitutional in the U.S. This is ironic because our 1st Amendment freedoms of speech and the press derive from British common law as it existed in 1776. Yet Britain never adopted a written Constitution, thus setting the stage for the modern day socialists to silence and stifle free speech by merely passing laws through Parliament.

Having thought about it, I know exactly what posts they'll use. The phrase "pakistani muslims" keeps cropping up, which brings race - however tangentially - into the discussion. The police and the media spent a lot of time ignoring a story about a group of muslims of pakistani origin who were, and possibly still are, grooming young girls for sex. It was reported for a day and then dropped like a hot potato once the muslim angle became apparent.
The daft thing is, pakistani muslims are pretty much as bad as he makes out, in general. I don't trust them. I wouldn't hesitate to trust a pakistani hindu if I ever encountered one but that would be quite rare, these days...
But that's the most likely target of the complaint.
And the really daft thing is that if that is what the they'll use they will in effect have made it illegal to write about the crimes of the "Italian mafia" or the crimes of the "Russian Mafia" as that would be every bit as much incitement to hatred.

You might want to take some time out and read Lionheart's blog. He has a fair amount of personal history there. He is from Luton, born and raised. He hasn't always made "good choices." He believes he was told a truth. He says he tried to do something to help his neighborhood and was vilified and threatened for it. There is a very local, on the ground, story at the heart of this.
I agree with Mr. Dawson, he has written extensively about a specific group of people in his neighborhood, and has at times named them. These guys are essentially his neighbors (or were if he has officially moved). There is a good chance this is a far more chilling story than just blogger's rights.
Lionheart shopped a drug dealer (Heroin Jihadi) and the dealer was sent to prison for a year. During that time the dealers mates (gangsters) have threatened to kill Lionheart. Lionheart has been living in fear and hiding on and off since then. The police have offered no assistance. Incidently the dealers have filled Lionhearts comment boxes with racist abuse where they have posted.
Lionheart is religious, and he sees himself as a kind of Knight. He has visited Israel.

In reading the text of the Public Order Act of 1986 from the perspective of one who has experience in the U.S. criminal justice system I must say that it would never pass the smell test in ANY U.S. court. There is virtually no statement one can utter that is not "insulting" to someone. The last time I checked "Pakistani" did not qualify as a race. What one intends by stating provable facts is way too vague without exhorting to violence. On the other hand, lionheart is unlikely to prevail in seeking political asylum in the U.S. on the basis of a first amendment defense. There are few nations with the written protections similar to the U.S. Constitution (except of course the USSR Constitution of 1936, and we know how effective that was).

Hokay, el, you're right on the money with this one. I've already emailed Lionheart a file containing some of the most egregious and offensive 2006 Iran Holocaust denial cartoons. I hope he will be able to introduce these in court to show how his own cartoon was weak tea by comparison. When one considers how Muslim women have already been apprehended smuggling bombs beneath their burqas, Lionheart's cartoon takes on an aura of realism.

Dear sir,
I am writing concerning the situation involving a British subject known as “Lionheart“. As I am sure you are aware, the gentleman is to be arrested upon his arrival in Great Britain on suspicion of inciting racial hatred. With the information available to me, there seems to be a gross miscarriage of justice taking place.
As you must also be aware, Lionheart has quickly become a symbol of a man being persecuted for publicly stating the effects on his life by certain criminal elements in his neighborhood. As a fellow blogger, Lionheart’s case will be followed closely and reported on extensively.
Due to this case I know of one British blogger who has already curtailed their blogging out of fear of being fasely accused of “hate crimes“. That sir, is a terrible statement on the state of affairs in Britain.
I can only hope that true British justice will prevail in this case and that Lionheart will be exonerated from these specious charges. Further, that those pressing these charges will be investigated for bearing false accusations. I would hope also that you will forward my concerns to the appropriate authorities.

I would note that one reason why America declared independence from Great Britain on July 4, 1776 was no such safeguard to liberty existed in the British Constitution, although freedom of speech was long known in the British common law.
It would appear that over 200 hundred years later the British government has returned to policy of oppression. I would note that the State of Great Britain have enjoyed generally good relations since the end of the revolutionary period with America. This "Special Relationship" is largely based on the two governments having a similar governmental establishments that protected the civil rights of the individual. The first and foremost of these rights being freedom of speech.
If the State of Great Britain proceeds with the illegal prosecution of the British Subject known as "Lionheart" on the basis of his exercise of freedom of speech, the British government will stand before the world as a tyranny. I do not see how the United States of America can stay allied in a "Special Relationship" with a European tyranny.

What worries me most is the completely random application of 'justice' we're witnessing. This is symptomatic of a totalitarian system where you have no clearly defined laws, or the laws are being applied so arbitrarily it leaves citizens in a state of fear trying to second-guess the rules they're expected to abide to.
The demonstration on February 6th 2006 looks like a key event. Here Muslim demonstraters were permitted statements and attacks on the Western culture so audacious and scary that the police didn't even try to stop it.
The Rule of Law is what we need to be able to counter totalitarian Islam effectively. Unfortunately, it seems to be failing, set to be replaced by arbitrary justice.
I have downgraded my opinion of the UK to semi-totalitarian because of this. It appears to be a democracy, having elections and all, but in reality the protection of dissenting opinion against thugs and intimidation seems to have dissolved, and one is only free to select who will be administering the party line - be they Tory or Labour.
Being born in Denmark is a favor of fortune that just can't be beat. I'll do my very best to live up to that honour.
Ray, you're right in saying religion may not be the primary motivating factor, however it would be much more difficult for this sort of prosecution to go ahead if it weren't for the fact that these laws are on the books, and the fact that muslims tend to abuse these laws to silence dissent against them. It's a demonstration of the straits we find ourselves in regarding the sheer amount of power our muslim minority can command. Don't like someone? Make a complaint under some race law and the PC-infected police force and CPS will put them out of the way for you, but only if you're one of the favoured minorities. Today that means muslims.

i am not currently resident in the UK, but would be happy to brainstorm this with anyone who is and would be in a position to make a complaint to a particular police force, preferably the bedfordshire police. if they are LEGALLY OBLIGED to investigate such complaints, what grounds could they have for ignoring it?
if they tried to dismiss it on the 'koran is off limit' grounds, it might be possible to go after, for example, the hadith. there will be so many different versions, publications, selections of hadith available, that you could make one complaint after another.
eventually, we will have to go after these texts. why not start laying the groundwork now? does anyone have a convenient list of the most anti-semitic hadith to hand?

I read most of Lionheart's website and came to the conclusion that this matter has nothing to do with a blogger criticising Islam. If anybody took the time to read the relevant section of the Religious hatred Act they would see quite clearly that blogging about Islam is not the issue. Even Lionheart doesn't know what he has written is the offending item.
It's likely to do with accusing the police of corruption and other statements to do with crime in the area.

el, you keep on repeating this exact same point and I, for one, hope you beat it like a frickin' drum until people catch on. If we are going to be subjected to "hate speech" laws then it's time to sauce goose and gander alike. The Koran is one of the most widespread and hateful documents on earth. It's long past tea to have this piece of filth put under the public microscope so that people can see just how vile it truly is. Unequal application of the law as engendered by "hate speech" and "hate crime" statutes is being used as a bludgeon upon free speech. This is a fundamental and grievous affront to individual liberty. I can only be grateful that we have individuals like the Baron and Dymphna looking after our legal interests. Bless you both.

I found something interesting at Political Correctness Watch:

Sounds pretty reasonable to me that he is concerned."
This supports what I've suspected and mentioned before: We're up against a mafia-like network which doesn't care where it gets its funding, how it kills its opponents or how it scares the crap out of law enforcement.
Taliban is largely drug-funded, just operating under a religious cover. In the Balkans, mafia & mujahedeen work in tandem. Money laundering is needed by both terrorrists and mafiosis.
There's a wedge to drive in somewhere on this issue, I think.
